The Supreme Court on Monday issued its detailed verdict on the extension of the chief of the army staff.

On November 28, the top court, in its short order, had allowed the federal government to grant a six-month extension to COAS General Qamar Javed Bajwa.

In the detailed verdict penned byJustice Mansoor Ali Shah and issued today, the court states that SC bench “explored the scope of Article 243 of the Constitution, reviewed the Pakistan Army Act, 1952, the Pakistan Army Act Rules, 1954”.

The court “found that the Pakistan Army Act, 1952 falls deficient of the structural requirements for raising and maintaining an Army under clause (3) of Article 243 of the Constitution”.

The verdict noted that “no tenure or age of retirement for the rank of General is provided under the law. As per the institutional practice a General retires on completion of a tenure of three years. Although an institutional practice cannot be a valid substitute of the law.”

“There is no provision in the law for extending service of a General for another tenure; nor is there any consistent and continuous institutional practice of granting such extension,” Justice Shah wrote, adding that the summaries for the reappointment, extension and fresh appointment of General Bajwa were “meaningless” in absence of the relevant law.

The verdict further stated that in the light of the attorney general’s assurances as well as the importance of the responsibilities of the COAS, it is appropriate that the incumbent COAS may continue for a period of six months.

However, the court warns that in the absence of legislation on the matter within six months, the institutional practice of retirement of a General on completion of the tenure of three years “shall stand enforced”.

Chief Justice of Pakistan Asif Saeed Khosa, in his additional note in the verdict, said that “in our peculiar historical context Chief of the Army Staff holds a powerful position in ways more than one,” adding that “unbridled power or position, like unstructured discretion, is dangerous.”

The chief justice further said that “it has been a shocking revelation to us that the terms and conditions of service of Chief of the Army Staff, the tenure of his office, extension in the tenure of his office or his reappointment have remained unregulated by any law so far.”

Justice Khosa, ended his note by saying that “the democratic maturity of our nation has reached a stage where this Court can proclaim that, as declared by Chief Justice Sir Edward Coke of England in the Commendam case in the year 1616 regarding the powers of King James I, “Howsoever high you may be; the law is above you”.

Prime Minister Imran Khan on Monday met United States Senator Lindsey Graham in Islamabad to discuss bilateral relations between the two countries, Geo News reported.

Foreign Minister Shah Mehmood Qureshi and other senior officials were also present during the meeting that took place at the Noor Khan airbase.

Graham, the head of the US Senate Judiciary Committee and a member of the Senate Foreign Relations Committee, had earlier met Prime Minister Imran on the sidelines of the UN General Assembly session in September.

They had also held a meeting in July when the prime minister had traveled to the US on a week-long official tour to mend the strained relationship between Islamabad and Washington.

Graham, at times considered an aide to US President Donald Trump, has been a vocal advocate of revitalising US-Pakistan ties in the interest of regional peace and security.

In earlier meetings with PM Imran, Graham had called for sustained and high-level engagement between the two countries, and appreciated Pakistani support for peace and reconciliation in Afghanistan.

Last week, US Special Envoy to Afghanistan Zalmay Khalizad had met high-ranking officials in Pakistan after the US resumed peace talks with Taliban earlier this month following a brief pause.

Pakistan has on numerous occasions called for a political solution to the Afghan conflict, and even facilitated the engagement between the US and the Taliban in a bid to end the armed conflict in the war-torn neighbouring country.

Chief of Army Staff (COAS) General Qamar Javed Bajwa on Monday has said that the horrific carnage of Army Public School that claimed lives of over 140 people including students will never be forgotten.

The 5th anniversary of a deadly school attack on Army Public School (APS) Peshawar that claimed the lives of over 140 people, mostly schoolchildren, is being observed across the country today (Monday), Dunya News reported.

On this day in 2014, six terrorists affiliated with Tehreek-e-Taliban Pakistan (TTP) had stormed the School and martyred one hundred and forty-seven students and teachers.

The deadliest attack in Pakistan’s history, the carnage prompted the government to declare an all-out war against terrorist outfits. In the wake of the attack, military courts were set up for trying terrorists under amendments made to the Constitution and the Army Act.

The mastermind of the APS massacre, Umar Mansour, alias Khalifa Mansour, alias Umar Naray, was killed in a drone strike in Afghanistan.

Five years on — despite the counter-terrorism National Action Plan (NAP) that was chalked out days after the APS massacre and other security strategies — educational institutions in Khyber Pakhtunkhawa remain a relatively easy target for militants.

The massacre changed the perception of Pakistan against terrorism and people in the country raised voices for a uniformed action against all types of militants.

Following the attack, political parties and security departments formed a National Action Plan to stem extremism and terrorism.

Later, Pakistani Parliament unanimously approved the formation of military courts for speedy trials of the hardcore terrorists.

According to reports, since the school attack, at least 1,584 terrorists were arrested and sent to jail. Apart from it, 167 high profile terrorists with head money were also detained or killed.
